We represent banks and financial service institutions in all
issues of banking law and banking regulatory matters.
In the field of banking law we especially advise on loan agreements including
the set up and evaluation of the corresponding collateral that is established
in connection with such agreements. We also give advice to our clients in
relation to their activities with customers in distress (issues of liability
of the financing institution and the avoidance of the set up of collateral).
Another field of practice of many years has been the financing of export transactions.
In addition, we have acquired in-depth special legal knowledge when it
comes to the handling of the sale of distressed debt.
When representing credit and financial services institutions before state
courts and arbitral tribunals, we rely on our experience and expertise of
many years. The central point of our activity in this field are issues of
liability of our clients in general banking law including the legal evaluation
and presentation of complex finance structures as well as the defence of our
clients against individual investors.
In the field of financial supervisory law we advise our clients at the starting
point of their banking activities in Germany as well as during their day to
day business operations.
One of the emphases of our activity is the timely information
and advising of our clients with regard to upcoming European and German legislative
and regulatory projects.
